|Public notice is hereby given that the Board of Supervisors of Washington Township, Dauphin County, will consider for enactment Ordinance No. 2020-01 as set forth in full below, on January 21, 2020, beginning 7 PM prevailing time, as part of the Supervisors regularly scheduled meeting, held at the Washington Township Municipal Building located at 185 Manors Road, Elizabethville, PA 17023. The ordinance proposes to amend Chapter 10, Health and Safety, Part 1 Anti-Nuisance Act to include guidelines for the operation of shooting ranges.
AN ORDINANCE OF THE TOWNSHIP OF WASHINGTON, A SECOND-CLASS TOWNSHIP OF THE COUNTY OF DAUPHIN, COMMONWEALTH OF PENNSYLVANIA. AMENDMENTS TO THE CODE OF ORDINANCES, CHAPTER 10, HEALTH AND SAFETY, PART 1 ANTI-NUISANCE ACT.
Now therefore, be it enacted by the Board of Supervisors, after a public meeting duly advertised, The Code of the Township of Washington, Chapter 10 Health and Safety, Part 1 Anti-Nuisance Act be amended as follows:
Amend §10-102 Description. Add to subsection 1.
Shooting Range guidelines to protect the health, safety, and welfare of the community.
Amend §10-103 Definitions. Add definition for the term shooting range:
Shooting Range – a place where any individual, public or private corporation for profit or not for profit, partnership, association, syndicate, company, firm, trust, political subdivision, municipality, district or other entity recognized by law as the subject of rights and duties, including any governmental agency or any organization of any kind that discharges firearms of any kind, including cross bows, bows, air guns or any device that launches a projectile.
Amend: §10-104 Nuisances Declared Illegal. Add a new subsection N.
No individual, public or private corporation for profit or not for profit, partnership, association, syndicate, company, firm, trust, political subdivision, municipality, district or other entity recognized by law as the subject of rights and duties, including any governmental agency or any organization of any kind that discharges firearms of any kind shall operate an indoor or outdoor shooting range without guidelines approved by the Washington Township Board of Supervisors. Guidelines may vary for each shooting range located within Washington Township based on location and surroundings. The Washington Township Board of Supervisors may change or approve new guidelines for each shooting range as circumstances change, to protect the health, safety and welfare of the community. The guidelines must meet Pennsylvania State Statutes and must include:
(1) Hours of shooting range operation. Hours of operation shall be between 8:00 AM and Sunset.
(2) No lead projectiles of any type shall be shot into and remain in the soils of the Township. Any lead projectiles shall be removed quarterly, with a report of removal submitted to Washington Township.
(3) Must meet the State Laws for no discharging firearms of any kind within a safety zone.
All Ordinances and parts of Ordinances inconsistent herewith are repealed.
WHEREAS, the Board of Supervisors have adopted this date. This Ordinance shall become effective five (5) days after its adoption.
DULY ENACTED AND ORDAINED THIS DAY OF 2020.
A copy of proposed Ordinance 2020-01 may be examined at the Washington Township Municipal Office during normal business hours and the Township website at wtwp.org. A copy may be obtained for a cost no greater than the cost thereof.
